Mr. Smolker is a graduate of New College of Florida (BA, Environmental Studies) and the University of Florida College of Law (JD). 

A former city planner, he co-authored the City of Bradenton Comprehensive Plan of 1979 and, following graduation from the University of Florida law school, served as Pasco County’s chief assistant county attorney before entering private practice. 

He is admitted to the Florida Bar, the U.S. District Court for the Northern, Middle and Southern Districts of Florida, the United States Court of Claims, the U.S Court of Appeals, 11th Circuit, and the U.S. Supreme Court.

For the last 40 years, his practice has encompassed local land use/zoning representation and administrative, civil trial and appellate practice in the areas of land use/zoning, comprehensive planning, environmental permitting, water law, wetland and wildlife regulation, coastal and submerged land rights, eminent domain, and inverse condemnation, including regulatory takings. He also is also experienced in real estate and land development law.

Mr. Smolker’s clients include private landowners, local and national developers and government agencies. He has also served as interim General Counsel to New College of Florida on a number of previous occasions.
